This Terms of Use Agreement (the “Agreement”) is a legally binding agreement between Hadi Aslam (“I,” “me,” or “my”), a freelance web designer and developer, and you (“Client,” “you,” or “your”) regarding your access to and use of my website (https://www.hadiaslam.com) and any associated services, tools, or deliverables.

By accessing or using my website or services, you accept and agree to be bound by these Terms and my Privacy Policy. If you do not agree, please discontinue use immediately.

1. Intellectual Property Rights

All assets, copy, graphics, designs, and source files created for your project (“Deliverables”) are my intellectual property until full payment is received. After full payment, the copyright for those Deliverables transfers to you.

However, any third-party materials (e.g. fonts, plugins, or stock assets) used in your project may require separate licensing from you, the client.

2. Ownership of Materials

You fully own the custom design and development work once payment is completed. I do not retain rights to resell or reuse your original work. However, I reserve the right to retain non-transferable templates, tools, or scripts developed prior to or separately from your project.

3. Third-Party Assets

If a project includes licensed assets (like fonts, stock images, or scripts), you are responsible for acquiring the appropriate commercial licenses to continue using those legally. I will always inform you when these are required.

4. Client Representations

By using my services, you confirm that:

• You are legally capable of entering into this agreement.
• You own (or have the rights to use) all materials provided to me.
• You will not use my services for any unlawful or abusive purposes.

5. Prohibited Uses

Clients must not:

• Attempt to copy or reproduce my proprietary systems or workflows.
• Abuse my services, time, or tools in any way.
• Use my content or processes for competitive purposes.
• Distribute or reuse my pre-built frameworks, templates, or proprietary components without permission.

6. Revisions and Feedback

You are encouraged to provide feedback during the design and development process. I promote open and clear communication via email, Trello, Notion, or your preferred async tools.

7. Refund Policy

I offer a 7-day refund window from the start of the project. If you’re unsatisfied, you may request a refund within the first 7 calendar days. A 25% processing and service fee applies to any approved refund.
Any assets delivered during the refund window may not be used.

8. Showcasing Work

I respect client confidentiality. I will only showcase your project on my portfolio, social media, or other channels with your written permission.

9. Downtime & Interruptions

I strive for smooth and timely delivery, but occasional delays or interruptions may occur due to unforeseen circumstances. I am not responsible for platform outages, third-party tool issues, or internet/server downtimes beyond my control.

10. Limitation of Liability

I am not liable for any indirect, incidental, special, or consequential damages that may arise from the use of my services. My maximum liability under any circumstances is the total amount paid to me by the client.
